PROBATE AND TRUST ADMINISTRATIONS

Navigating the Administration of an Estate or Trust

The death of a loved one often leads to overwhelming emotional and legal complications. With over forty (40) years of experience in handling probate and trust administrations, Lauer Law can help you fulfill your legal responsibilities.

During the initial conference with the Personal Representative (or Executor/Executrix) of a Will and/or the Trustee of a Trust, we discuss in detail the assets of the estate and/or trust, the legal documents, and family dynamics to develop a strategy to transfer the assets of an estate or trust in compliance with the legal documents and Florida law. We explain the process step by step to make certain that you understand your legal options and obligations during the probate and/or the trust administration. Since every administration is unique, we determine exactly what needs to be done in each administration. After the initial conference, we draft an “engagement letter” to the client detailing and reiterating what needs to be done to act as a checklist for the client through the process. Throughout the process, we keep clients updated on what needs to be done and how to do it to make the process as easy and painless as possible.

We offer legal and financial resources that can help you through these situations:

  • How do I know whether a probate proceeding is necessary?

  • How can I settle my mom’s Will in Vero Beach if I live out-of-state?

  • What do I do if my parents did not have a Will?

  • What do I need to do if I was appointed executor/personal representative of my dad’s Will?

  • How do I transfer the deeds and titles for my parents’ real estate?

  • How do I reregister a “Pay on Death” or “Transfer on Death” asset into my name?

  • Am I paying the correct amount of inheritance/estate taxes?

  • Do I need to pay mom’s income taxes?

We can also act assist in resolving conflicts that may occur during the process, as explained on our Probate and Trust Litigation Page.
